AN ACT CONCERNING HEALTH CARE CENTERS AND INSOLVENCY PROTECTION.

To authorize out-of-network benefits of a health care center in an amount in excess of ten per cent of the center's claims with the prior approval of the Insurance Commissioner and the establishment of an uncovered expenditures insolvency deposit; to specify contractual provisions dealing with situations when a health care center fails to pay for health care services pursuant to its contract with a participating provider, and holding the enrollee harmless for such expenses; to require that the contract between a health care center and a participating provider shall inform the provider of the provisions of the law making it an unfair trade practice to request payment from an enrollee, other than a copayment or deductible, for covered medical services, or to report to a credit reporting agency an enrollee's failure to pay a bill for medical services when a health care center has primary responsibility for payment of such services; to require health care centers to deposit five hundred thousand dollars with the Insurance Commissioner to be used to protect enrollees and assure continuation of coverage of health care services to enrollees of a center that is in receivership; and to adopt a new section which requires health care centers to post an additional deposit equal to at least one hundred twenty per cent of uncovered expenditures, if uncovered expenditures exceed ten per cent of total health care expenditures of the health care center.
