AN ACT LIMITING THE USE OF EMINENT DOMAIN BY MUNICIPALITIES AND MUNICIPAL DEVELOPMENT AGENCIES AND ESTABLISHING AN OFFICE OF PROPERTY RIGHTS OMBUDSMAN.

To (1) eliminate the use of eminent domain by (A) a municipality or development agency to acquire property within a municipal development project area, and (B) an implementing agency to acquire property in a development plan under the Manufacturing Assistance Act; (2) establish an Office of Property Rights Ombudsman; (3) permit a private property owner to request that the ombudsman arbitrate an eminent domain or relocation assistance dispute between the owner and a public agency; and (4) require a public agency to make a reasonable effort to negotiate with a property owner before starting an eminent domain action and provide the property owner with certain information before filing such an action, including information about the ombudsman.
