Permanent Regulation
For a regulation with a Notice of Intent posted on , a public comment period lasting days is required to be held between and .
At the end of the public comment period, the agency shall consider all written and oral submissions. If their response to comments takes place over a period of days, this will occur between and .
The agency will post the Notice of Decision by when they will submit the regulation to the Office of the Attorney General. The Office of the Attorney General will have from to to review the regulation and approve it for legal sufficiency. If the regulation is approved by the Office of the Attorney General on and the agency submits it to the Legislative Regulation Review Committee by the first Tuesday of the month, the regulation will be scheduled for action on the following month's agenda.
The Legislative Regulation Review Committee meets on the fourth Tuesday of every month, except in December when it meets on the third Tuesday due to holidays. Once the Legislative Regulation Review Committee approves the regulation, the agency has fourteen days to make the corrections outlined in the Legislative Commissioners' Office report before the regulation is sent to the Office of the Secretary of the State. The Office of the Secretary of the State has ten days to post the regulation, at which point, unless noted otherwise in the regulation documents, it becomes effective.
Technical Amendment
When the Notice of Intent for a technical amendment is posted on , the agency submits the regulation to the Office of the Attorney General. The Office of the Attorney General will have from to to review the regulation and approve it for legal sufficiency. If the technical amendment is approved by the Attorney General on and the agency also submits it to the Legislative Regulation Review Committee by the first Tuesday of the month, the regulation will be scheduled for action on the following month's agenda.

Emergency Regulation
For an emergency regulation that is submitted to the Legislative Regulation Review Committee on , the committee has fifteen calendar days to take action otherwise the regulation is deemed approved. An approved emergency regulation shall be effective for 180 days from the date of approval or the date by which it is deemed approved. If the committee meets on the fifteenth day after submission and approves the emergency regulation, it would be effective from until .
If the emergency regulation originates from the Commissioner of the Department of Energy and Environmental Protection in order to comply with the provisions of interstate fishery management plans adopted by the Atlantic States Marine Fisheries Commission, or to meet unforeseen circumstances or emergencies affecting marine resources, it can be extended for an additional sixty days. In that case, it would be extended until .
