The Senate was called to order at 12: 55 p. m. in accordance with the provisions of Senate Rule 9(f), and under the authority of the President Pro Tempore and the Senate Republican Leader.

The prayer was offered by Acting Chaplain, Carmela Balducci of Deep River, Connecticut.

Pursuant to Senate Rule 9(f) the Senate is called into Session, by the Office of the Senate Clerk's under the authority of the President Pro Tempore and the Senate Republican Leader.

S. B. No. 348 (RAISED) ENVIRONMENT. 'AN ACT CONCERNING NIGHT HUNTING OF COYOTES', to authorize the hunting of coyotes at night, similar to raccoon and opossum hunting.

S. B. No. 349 (RAISED) ENVIRONMENT. 'AN ACT CONCERNING REGIONAL ANIMAL SHELTERS', to provide funding for part of the cost of operating regional animal shelters.

H. B. No. 5370 (RAISED) GENERAL LAW. 'AN ACT CONCERNING CHANGE ORDERS IN CONSTRUCTION CONTRACTS', to require a minimum amount be included in private and public commercial construction contracts for work performed pursuant to a change order.

HIGHER EDUCATION AND EMPLOYMENT ADVANCEMENT

H. B. No. 5338 (RAISED) HIGHER EDUCATION AND EMPLOYMENT ADVANCEMENT. 'AN ACT CONCERNING THE FUNDING AND EXPANSION OF CERTAIN CERTIFICATE PROGRAMS', to provide a means of additional funding for those certificate programs that have a high employment rate for students in their field of study following graduation.

H. B. No. 5371 (RAISED) HIGHER EDUCATION AND EMPLOYMENT ADVANCEMENT. 'AN ACT ESTABLISHING THE FREE 2 START SCHOLARSHIP PROGRAM AND THE FREE 2 FINISH SCHOLARSHIP PROGRAM', to provide scholarships to students of low and moderate income families that cover the unpaid portion of such students' tuition.

H. B. No. 5372 (RAISED) HIGHER EDUCATION AND EMPLOYMENT ADVANCEMENT. 'AN ACT CONCERNING DYSLEXIA INSTRUCTION OFFERED IN TEACHER PREPARATION PROGRAMS', to clarify the components of dyslexia instruction offered in teacher preparation programs in the state.

H. B. No. 5373 (RAISED) HIGHER EDUCATION AND EMPLOYMENT ADVANCEMENT. 'AN ACT CONCERNING STUDENTS IN CRISIS AT INSTITUTIONS OF HIGHER EDUCATION', to provide one-time emergency expense grants to students who experience unexpected financial hardships that impede such students' ability to complete their degree.

H. B. No. 5374 (RAISED) HOUSING. 'AN ACT REQUIRING CERTAIN HOUSING PROJECTS TO PROVIDE MEETING SPACE FOR TENANTS', to require certain housing projects to provide meeting space for tenants.

H. B. No. 5375 (RAISED) HOUSING. 'AN ACT CREATING A WORKING GROUP TO STUDY HOUSING OPTIONS FOR PERSONS REENTERING THE COMMUNITY AFTER INCARCERATION', to create a working group to study housing options for persons reentering the community after incarceration.

H. B. No. 5376 (RAISED) HOUSING. 'AN ACT LIMITING RENT INCREASES IN CERTAIN MULTIFAMILY DWELLINGS', to limit rent increases by property owners who have received, or are receiving, state financial assistance for the construction, rehabilitation or renovation of a multifamily dwelling.

H. B. No. 5377 (RAISED) HOUSING. 'AN ACT CREATING A TASK FORCE TO STUDY METHODS TO PREVENT THE OVERCROWDING OF SATELLITE DISHES ON THE ROOFS OF SINGLE-FAMILY AND MULTIFAMILY HOMES IN THIS STATE', to create a task force to study methods to prevent the overcrowding of satellite dishes on single-family and multifamily homes in this state.

INSURANCE AND REAL ESTATE

H. B. No. 5378 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT CONCERNING AFFIRMATIVE ATTESTATIONS BY SPECIALISTS REGARDING PRESCRIPTION DRUGS', to require that certain specialists affirmatively attest that they have informed an insured's primary care provider of certain prescriptions issued, and changes in prescriptions made, by such specialists or risk delaying reimbursement.

H. B. No. 5379 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT ESTABLISHING A STATE INDIVIDUAL HEALTH CARE RESPONSIBILITY FEE AND THE CONNECTICUT HEALTH CARE SAVINGS PROGRAM', to establish (1) a state individual health care responsibility fee for taxpayers who fail to maintain minimum essential health insurance coverage, and (2) the Connecticut Health Care Savings Program.

H. B. No. 5380 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT CONCERNING CLINICAL PEER REVIEW PERFORMED FOR PURPOSES OF A UTILIZATION REVIEW', to require that a clinical peer who performs a clinical peer review during a utilization review be licensed in this state in the same specialty as typically manages the medical condition, procedure or treatment under review.

H. B. No. 5381 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT IMPOSING A SURCHARGE ON CERTAIN PERSONAL RISK INSURANCE POLICIES TO FUND REGIONAL FIRE SCHOOLS' OPERATING BUDGETS AND CERTAIN FIREFIGHTER TRAINING COSTS', to impose a surcharge on the net direct premiums of homeowners and renters insurance policies written by insurance companies, on property or risks located or resident in this state, to fund the operating budgets of regional fire schools, certain training costs and fees and purchases of fire equipment.

H. B. No. 5382 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT CONCERNING CONTINUITY OF CARE AND NETWORK ADEQUACY', to expand the definition of "active course of treatment" within the context of continuity of care, require that the Insurance Commissioner redetermine the sufficiency of a health carrier's network when a health system leaves the health carrier's network and require that health carriers disclose additional information to covered persons regarding continuity of care.

H. B. No. 5383 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT CONCERNING DISPUTES BETWEEN HEALTH CARRIERS AND PARTICIPATING PROVIDERS THAT ARE HOSPITALS', to (1) extend the notice periods before a participating provider's departure or removal from a provider network, and (2) require that health carriers and participating providers that are hospitals continue to abide by the terms of certain contracts for sixty days.

H. B. No. 5384 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT CONCERNING PRESCRIPTION DRUG COSTS', to impose additional disclosure and reporting requirements on pharmacy benefits managers, health carriers, pharmaceutical manufacturers, the Office of Health Strategy and the Insurance Department concerning prescription drug rebates and the cost of prescription drugs.

H. B. No. 5385 (RAISED) INSURANCE AND REAL ESTATE. 'AN ACT ESTABLISHING A WORKING GROUP TO STUDY HEALTH INSURANCE PREMIUM RATE INCREASES AND DEVELOP RECOMMENDATIONS TO MITIGATE SUCH INCREASES', to establish a working group to study health insurance premium rate increases in this state and develop recommendations to mitigate such increases.

H. B. No. 5386 (RAISED) LABOR AND PUBLIC EMPLOYEES. 'AN ACT CONCERNING VARIOUS PAY EQUITY AND FAIRNESS MATTERS', to strengthen provisions of the law concerning pay equity and fairness.

H. B. No. 5387 (RAISED) LABOR AND PUBLIC EMPLOYEES. 'AN ACT CONCERNING PAID FAMILY MEDICAL LEAVE', to establish a paid family and medical leave system in Connecticut.

H. B. No. 5388 (RAISED) LABOR AND PUBLIC EMPLOYEES. 'AN ACT CONCERNING A FAIR MINIMUM WAGE', to provide more economic security to Connecticut families by increasing the minimum fair wage.

TRANSPORTATION

H. B. No. 5389 (RAISED) TRANSPORTATION. 'AN ACT CONCERNING TRANSPORTATION ISSUES', to allow temporary and permanent livery permit holders to use stretcher vans to transport elderly persons and persons with disabilities who must be transported on a stretcher.

H. B. No. 5390 (RAISED) TRANSPORTATION. 'AN ACT CONCERNING HIGHWAY SAFETY AND CRIMINAL HISTORY RECORDS CHECKS FOR OPERATORS OF SCHOOL BUSES', to allow a person who applies for a public passenger endorsement to operate a school bus, while the application is pending, to operate a school bus.

H. B. No. 5391 (RAISED) TRANSPORTATION. 'AN ACT CONCERNING TRANSPORTATION INFRASTRUCTURE', to require the Commissioner of Transportation to conduct studies and satisfy other requirements pursuant to the National Environmental Policy Act for the purposes of developing electronic tolling systems on the highways of this state.

H. B. No. 5392 (RAISED) TRANSPORTATION. 'AN ACT CONCERNING AIRPORTS', to implement requirements for meteorological tower markings.

H. B. No. 5393 (RAISED) TRANSPORTATION. 'AN ACT ESTABLISHING THE CONNECTICUT TRANSPORTATION FINANCE AUTHORITY TO MAINTAIN MAJOR STATE HIGHWAYS', to establish the Connecticut Transportation Finance Authority to maintain major state highways if and when the General Assembly authorizes the implementation of electronic tolling systems on such major state highways.

APPROPRIATIONS

H. B. No. 5394 (RAISED) APPROPRIATIONS. 'AN ACT CONCERNING THE LEGALIZATION AND REGULATION OF THE RETAIL SALE OF MARIJUANA', to develop a plan to legalize and regulate the retail sale of marijuana in the state and to provide for substance abuse treatment, prevention, education and awareness programs and measures.

AGING

H. B. No. 5395 (RAISED) AGING. 'AN ACT CONCERNING TRAINING AND EXPERIENCE REQUIREMENTS FOR PROVIDERS OF SERVICES TO SENIOR CITIZENS', to provide information to consumers regarding the background and financial arrangements of persons providing senior planning services.

BANKING

H. B. No. 5396 (RAISED) BANKING. 'AN ACT PROTECTING VICTIMS OF FRAUD BY CERTAIN FINANCIAL INSTITUTIONS', to allow private citizens to file lawsuits on behalf of the state to enforce violations of the Connecticut Unfair Trade Practices Act.

H. B. No. 5397 (RAISED) BANKING. 'AN ACT CONCERNING ECONOMIC DEVELOPMENT', to establish a task force to study ways in which the state may (1) encourage the growth of business, (2) stimulate job growth and increase municipal tax revenue, and (3) address concerns regarding the availability of financing after the merger, takeover or liquidation of a financial institution.

H. B. No. 5398 (RAISED) BANKING. 'AN ACT PROHIBITING STATE AND LOCAL LAW ENFORCEMENT AGENCIES FROM PROVIDING CERTAIN PROPERTY TO A FEDERAL AGENCY FOR THE PURPOSE OF SUCH PROPERTY'S FORFEITURE', to prevent state and local law enforcement agencies from (1) transferring property seized under state law to a federal agency for the purpose of such property's forfeiture under federal law, and (2) receiving from a federal agency proceeds of certain property seized under federal law.

H. B. No. 5399 (RAISED) BANKING. 'AN ACT CONCERNING THE ASSIGNMENT OF CERTAIN PROPERTY TAX, WATER AND SEWER LIENS', to (1) limit the assignment of unpaid property tax, water and sewer liens, and (2) ensure that persons responsible for the payment of such liens are notified of any such assignment.

H. B. No. 5400 (RAISED) BANKING. 'AN ACT CONCERNING LICENSING REQUIREMENTS FOR CONSUMER COLLECTION AGENCIES', to remove the requirement that consumer collection agencies have a minimum tangible net worth of fifty thousand dollars.

H. B. No. 5401 (RAISED) BANKING. 'AN ACT CONCERNING FEES FOR CASHING PAYROLL DRAFTS', to clarify that the commissioner shall adopt regulations establishing the maximum fees that may be charged by a check cashing licensee for cashing a payroll draft.

H. B. No. 5402 (RAISED) BANKING. 'AN ACT CONCERNING THE REPORTING OF RESIDENTIAL CUSTOMER'S NONPAYMENT FOR CERTAIN UTILITY AND TELECOMMUNICATION SERVICES', to delay certain utility and telecommunication companies from reporting customer's nonpayment for service to credit rating agencies.

H. B. No. 5403 (RAISED) BANKING. 'AN ACT CREATING A TASK FORCE TO STUDY LEAD ABATEMENT', to study issues concerning lead abatement.

H. B. No. 5404 (RAISED) BANKING. 'AN ACT CONCERNING THE AUTHORITY OF CONNECTICUT CREDIT UNIONS TO MAKE MEMBER BUSINESS LOANS THAT MEET CERTAIN FEDERAL REQUIREMENTS', to allow Connecticut credit unions to issue member business loans, provided such loans comply with federal law.

H. B. No. 5405 (RAISED) BANKING. 'AN ACT CONCERNING CONNECTICUT CREDIT UNIONS', to: (1) Allow Connecticut credit unions to, without prior approval from the Commissioner of Banking, engage in any activity that a federal credit union or out-of-state credit union may be authorized to engage in under state or federal law; (2) require the Commissioner of Banking to report certain information; (3) change the requirements for reviewing policies adopted by the governing board of a Connecticut credit union; (4) allow Connecticut credit unions to provide electronic notices of certain meetings; (5) allow members of a Connecticut credit union to vote by electronic means; and (6) expand the area of operation and services of Connecticut credit unions.

H. B. No. 5406 (RAISED) BANKING. 'AN ACT CONCERNING CASH REFUNDS FOR THE BALANCE OF A GIFT CARD', to increase the minimum balance amount for which a consumer using a gift card may request a cash refund.
