AN ACT CONCERNING LEAD SERVICE LINE REPLACEMENT.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2018) (a) For purposes of this section:

(1) "Customer" means a customer of a water company;

(2) "Customer lead service line" means the portion of a lead service line that is owned by the customer, located between the curb stop and the building owned or occupied by the customer;

(3) "Lead service line" means a service line that contains lead;

(4) "Lead service line replacement plan" means a plan developed by a water company to replace customer lead service lines;

(5) "Service line" means the service pipe from the main to the curb stop, at or adjacent to the street line or the customer's property line and such other valves and fittings as the utility may require at or between the main and the curb stop, including the curb stop, but not including the curb box; and

(6) "Water company" has the same meaning as provided in section 16-1 of the general statutes.

(b) A water company may develop a lead service line replacement plan. Such plan shall (1) include the process such company used to identify lead service lines, (2) state the number of lead service lines and customer lead service lines identified by the water company, (3) include the number of customer lead service lines that will be replaced, (4) include the proposed schedule and costs for such replacements of customer lead service lines, (5) identify any opportunities to perform such replacements of customer lead service lines in conjunction with the replacement of service lines owned by the water company, and (6) include the proposed portion of the cost of such replacement that will be paid by the customer or the amount and duration of any proposed rate surcharge, new tariff, rate rider or rate adjustment to be charged to the customer to cover all or part of the cost of the replacement service line at such customer's premise. Such water company may submit such lead service line replacement plan to the Public Utilities Regulatory Authority for approval.

(c) Upon receipt of a lead service line replacement plan from a water company pursuant to subsection (b) of this section, the authority may approve or reject such plan, provided in giving any such approval, notwithstanding any proposed cost recovery mechanisms included in such plan, the authority shall determine, in its discretion, any cost recovery mechanisms pursuant to subsection (d) of this section.

(d) Notwithstanding any other provisions of the general statutes, if the authority approves such plan, the authority may authorize such water company to recover costs incurred for the replacement of customer lead service lines by (1) including such costs in such water company's rate base and adjusting such water company's rates, (2) creating a new tariff, (3) creating a new rate rider, or (4) implementing a customer surcharge.

This act shall take effect as follows and shall amend the following sections:

To allow water companies to submit lead service line replacement plans to the Public Utilities Regulatory Authority and to allow the authority to authorize cost recovery mechanisms for the replacement of customer lead service liens.
