OLR Bill Analysis

sSB 104 (File 5, as amended by Senate "A")*

AN ACT PROHIBITING THE USE OF RESIDENTIAL AUTOMATIC PESTICIDE MISTING SYSTEMS.

SUMMARY

This bill prohibits, beginning January 1, 2019, installing or utilizing a residential automatic pesticide misting system in Connecticut.

Under the bill, a “residential automatic pesticide misting system” is a device designed to automatically spray a pesticide solution at timed intervals and be installed on, near, or around a home's exterior or grounds.

The bill authorizes the energy and environmental protection commissioner to adopt implementing regulations, which may include a fine for violating the ban.

*Senate Amendment “A” expands the ban to include the use of all residential automatic pesticide misting systems, rather than only those located 20 feet or less from a property line and eliminates a specific allowance for the systems' use in commercial nurseries and for agricultural applications.
