AN ACT CONCERNING VOLUNTARY PLACEMENT IN THE CUSTODY OF THE DEPARTMENT OF CHILDREN AND FAMILIES AND PARENTAL RIGHTS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That title 17a of the general statutes be amended to require that when a child or youth is admitted on a voluntary basis into an out-of-home placement administered by the Department of Children and Families for the purpose of obtaining treatment for a mental health issue or developmental disability, the department shall be prohibited from requesting, recommending or requiring that the child or youth's parent or guardian terminate his or her parental rights with respect to the child or youth or that the child or youth's parent or guardian transfer legal custody of the child or youth to the department.

Statement of Purpose:

To protect parental rights when a child is voluntarily placed in out-of-home care for the purpose of obtaining treatment for a mental health issue or developmental disability.
