REASONS FOR BILL:

The reason for this bill is to require the State Department of Education (SDE) to conduct a study regarding issues related to elementary and secondary issues in the state of Connecticut. The results of such report are to be submitted to the Education Committee by July 22, 2018.

Substitute Language:

The substitute language for this bill accomplishes the following:

The title of the bill is changed from “AN ACT CONCERNING ELEMENTARY AND SECONDARY ISSUES” to “AN ACT CONCERNING UNSUBSTANTIATED ALLEGATIONS OF ABUSE AND NEGLECT BY SCHOOL EMPLOYEES.

Lines 9-10 contain the addition of “school employee” and “the employing school or school district” to the groups and individuals to be notified with the results of an investigation into allegations of abuse or neglect by a school employee.

Lines 63-64 contain the deletion of “Commissioner of Children and Families” and the replacement thereof with “commissioner.”

Lines 85-95 state that in the event that a school employee accused of abuse or neglect is found to be innocent of such charges, the employee, the employee's superintendent and school district, and the Commissioner of Education are to be notified of such findings by the Commissioner of Children and Families, and the record of the unsubstantiated charges must be removed from the employee's records.

Lines 96-110 state that regardless of any discovery by the Commissioner of Children and Families that charges of abuse or neglect are unsubstantiated, the Department of Education and local board of education should carry out their own investigation and disciplinary action, should such action be required.

Each mention of section 17a-101 is supplemented with the phrase “as amended by this act.”
