AN ACT REQUIRING PRIOR LEGISLATIVE APPROVAL OF INCREASES IN ASSESSMENTS AND USER FEES CHARGED BY THE CONNECTICUT HEALTH INSURANCE EXCHANGE.
This bill allows, with legislative approval in certain circumstances, the Connecticut Health Insurance Exchange (i.e., Access Health CT) to (1) increase health carrier assessments or user fees or (2) change the methodology used to calculate assessments or user fees. By law, the exchange can charge health carriers capable of offering qualified health plans through the exchange assessments or user fees to fund the exchange's operations.
Under the bill, the exchange must submit to the Insurance and Real Estate Committee any (1) proposed increase in assessments or user fees of more than 15% in any one-year period or 35% in any three-year period and (2) proposed change in calculation methodology. If the committee does not take action on the submission within 15 days after receiving it, the increase or methodology change is deemed approved.
*Senate Amendment “A” (1) limits the assessment or user fee increases that must be submitted to the Insurance and Real Estate Committee for approval; (2) decreases the committee's time to take action on such a submission from 60 days to 15 days; and (3) deems a submission approved, rather than denied, if the committee does not take action within that time period.
