Representative Stephen Dargan

REASONS FOR BILL:

Ms. Corbett is a Community Training Home provider who had her refrigerator, walls and screen door damaged by a client. While the Department of Social Services had paid for such expenses in the past they did not in this instance. Her claim was initially thrown out by the claims commissioner for being time barred despite first trying to resolve the issue with DSS and then filing with the superior court. This bill seeks to resolve that issue and return it to the claims commissioner for a hearing on the merits.

RESPONSE FROM ADMINISTRATION/AGENCY:

None

NATURE AND SOURCES OF SUPPORT:

Millicent Corbett testified at the hearing that she was reimbursed for DSS for an incident in November 2006 but was not paid for an incident in October 2009. She is seeking $50,000 for damages and pain and suffering.

NATURE AND SOURCES OF OPPOSITION:

None
