Explanation

The amendment requires persons seeking to obtain a motor vehicle operator's license but who are unable to establish legal presence in the United States to undergo a national criminal history background check. Since the program's inception in early FY 15, the Department of Motor Vehicles (DMV) has issued approximately 45,639 appointments to such persons. This number is expected to be approximately 25,000 in FY 16 and 10,000 in FY 17.

The Federal Bureau of Investigation charges approximately $14.75 to perform a national criminal history background check. To provide background checks to persons covered under the amendment, the Department of Emergency Services and Public Protection (DESPP) is anticipated to incur federal fees of approximately $370,000 in FY 16 and $150,000 in FY 17. These fees are anticipated to be reimbursed by DMV consistent with statutory allowance. However, it is unclear in the amendment whether DMV will be able to pass that cost along to such applicants. If such costs are passed onto applicants, the potential cost noted above for DMV would be eliminated.

Additionally, as DESPP currently performs approximately 100,000 national criminal history background checks annually for various licensing and employment purposes, the additional checks required under this bill (25,000 in FY 16 and 10,000 in FY 17) are anticipated to require additional staff to perform. DESPP is anticipated to require approximately three processing technicians at a total annual salary of approximately $145,000 plus fringe benefits of approximately $56,000 beginning in FY 16.
