"AN ACT ESTABLISHING A LIVESTOCK CARE STANDARDS ADVISORY COUNCIL. "

Strike everything after the enacting clause and substitute the following in lieu thereof:

"Section 1. (NEW) (Effective October 1, 2014) (a) There is established an Important Bird Areas Advisory Committee for the purpose of advising the Department of Energy and Environmental Protection on the creation of an Important Bird Area Program that shall include, but not limited to, the identification and recognition of critical bird habitats and the promotion of bird conservation in the state. Such committee shall consist of not more than ten members appointed by the Commissioner of Energy and Environmental Protection and shall serve at the pleasure of the commissioner. The members of such committee shall be individuals who represent organizations that have a record of activity in bird conservation or who have an expertise or a recognized knowledge in an area pertinent and valuable to such program. Such advisory committee shall meet not less than twice each calendar year. Any staff of the Department of Energy and Environmental Protection designated by the commissioner to serve on such committee shall serve as nonvoting members of such committee. Such committee shall elect a chairman from among its membership on or before October 31, 2014. The chairman of such committee shall be unaffiliated with any state agency.

(b) The Commissioner of Energy and Environmental Protection may designate state-owned waters or state-owned lands, or any portion thereof, under the commissioner's custody, as an important bird area provided such designation is consistent with the mission and duties of the Department of Energy and Environmental Protection. Prior to making or removing any such designation, the commissioner shall publish notice concerning the impending designation or removal of an important bird area in the Environmental Monitor. Such notice shall provide for a thirty-day public comment period commencing on the next business day following the date of publication. Any state-owned waters or state-owned lands, or portion thereof, designated as an important bird area pursuant to this subsection shall be described and depicted on a map. The commissioner shall retain an inventory of any state-owned waters or state-owned lands, or portion thereof, that are designated as important bird areas pursuant to this subsection. "

This act shall take effect as follows and shall amend the following sections:
