The amendment strikes the underlying bill and its associated fiscal impact.
Instead the amendment requires the Department of Energy and Environmental Protection (DEEP) to allow the choice of in-state or out-of-state disposal of municipal solid waste (MSW) in the agency's solid waste management plan (SWMP) under certain circumstances. To the extent additional MSW is shipped out-of-state, municipalities may realize savings, as out-of-state disposal options are anticipated to result in lower tip fees to municipalities. To the extent a certain tonnage of MSW is already being shipped out-of-state currently, no additional municipal savings would be realized.
