Strike everything after the enacting clause and substitute the following in lieu thereof:

"Section 1. (NEW) (Effective from passage) The Connecticut Siting Council, in consultation with the Department of Public Utility Control and the Department of Environmental Protection, shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, concerning the siting of wind turbines. Such regulations shall include, but not be limited to, (a) specific criteria concerning (1) setbacks, including considerations of tower height and distance from neighboring properties; (2) flicker; (3) ice throw; (4) blade shear; (5) impact on natural resources; and (6) noise; and (b) requirements that a developer or owner to decommission a wind turbine facility at the end of its useful life. Such regulations may establish different requirements for projects of different sizes. The council shall hold a public hearing prior to rendering a decision related to an application or petition for wind turbine projects. The siting council shall implement policies and procedures that include specific criteria for the items in subsection (a) of this section, not later than October 1, 2011, while in the process of adopting regulations pursuant to this section, provided notice of such policies and procedures are published in the Connecticut Law Journal at least twenty days prior to their implementation and such policies and procedures shall be valid until the time final regulations are effective. Such policies and procedures shall apply to applications or petitions pending as of the effective date of this section. "

This act shall take effect as follows and shall amend the following sections:
