After the last section, add the following and renumber sections and internal references accordingly:

"Sec. 501. (NEW) (Effective October 1, 2011) Any person, as defined in section 8-267 of the general statutes, or any state agency, as defined in said section 8-267, that operates a United States Department of Housing and Urban Development, Section 202 or Section 236 elderly housing development, an elderly housing project pursuant to part VI of chapter 128 of the general statutes or congregate housing pursuant to part VII of chapter 128 of the general statutes with a smoking policy restricting smoking to certain designated areas on the property of such development, project or housing shall provide covered shelter in at least one designated area. Such covered shelter shall be heated when the outdoor temperature is below sixty degrees Fahrenheit. The provisions of this section shall not apply to any such development, project or housing that provides a heated indoor area for smoking with secondhand smoke control. "

This act shall take effect as follows and shall amend the following sections:
