The amendment makes any existing mandated health benefit optional, yet requires insurers to offer them as an optional benefit that may be purchased separately. It should be noted that state employee and retiree health benefits are subject to collective bargaining. To the extent that the state is able to reduce benefits offered under the state employee and retiree health plan, potential savings may result in FY 12 upon contract renewal.

The amendment may result in potential savings to municipalities to the extent that municipalities reduce benefits offered upon contract renewal on or after January 1, 2010.
