Explanation

The amendment increases from 5 to 10 years the mandatory minimum prison sentence for aggravated sexual assault in the first degree. This change would lengthen the term of imprisonment for any offender who otherwise would have been sentenced to the minimum prison term provided under current law (5 years) . Each year there are approximately 6 convictions to which this penalty enhancement would apply. It is anticipated that one or more of these offenders would receive lengthier prison sentences as a consequence of the amendment and therefore the Department of Correction would begin to incur significant (i.e., greater than $100, 000) annual costs in FY 16 and beyond. On average, it costs the state $44, 165 to incarcerate an offender.
