Strike everything after the enacting clause and substitute the following in lieu thereof:

"Section 1. (NEW) (Effective July 1, 2009) The Commissioner of Public Health shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to set standards for the provision of elective diagnostic obstetrical ultrasounds provided by a commercial establishment in exchange for a professional fee. Such regulations shall include, but not be limited to, requirements concerning: (1) The types of diagnostic services that may be provided as part of an elective obstetrical ultrasound, including, but not limited to, calculation of gestational age, fetal position, fetal heart rate and fetal movement; (2) the maximum amount of time permitted for an elective diagnostic obstetrical ultrasound; (3) the maximum number of elective diagnostic obstetrical ultrasounds that a woman may have during the course of a pregnancy; (4) provider training and certification requirements with respect to those who administer such ultrasounds; and (5) certification and inspection requirements concerning medical devices used to perform such elective diagnostic obstetrical services. "

This act shall take effect as follows and shall amend the following sections:
