TOWN NOTIFICATION BY STATE ECONOMIC DEVELOPMENT COMMISSIONER

You asked if any other states have a law or regulation similar to sHB 5635, “An Act Concerning the Retention of Businesses in Municipalities.”

The bill requires the Connecticut Development Authority and the Department of Economic and Community Development to notify municipalities when finalizing an offer that could cause a business to relocate to another Connecticut municipality.

We were unable to find any similar law or regulation in any other state. New York requires the business itself to notify the municipality it is leaving. Several other states have laws or regulations covering the relocation of an enterprise from one municipality to another in the state, including the need for a county to obtain a waiver from the state to talk to a business in another county (Kansas, Kan. Admin. Regs. 110-3-4).
