AN ACT CONCERNING PAID LEAVE FOR STATE'S ATTORNEYS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective July 1, 2008) (a) All officers as defined in section 5-196 of the general statutes who are appointed to the position of Chief State's Attorney, Deputy Chief State's Attorney or State's Attorney shall be eligible for paid vacation time, sick leave and personal leave in accordance with section 5-247 and sections 5-250 to 5-253, inclusive, of the general statutes and any relevant regulations adopted pursuant to chapter 67 of the general statutes. The paid leave policies, including lump sum payment of unused leave at termination, for such positions may be set by the Commissioner of Administrative Services subject to the approval of the Secretary of the Office of Policy and Management in accordance with section 5-200 of the general statutes.

(b) No vacation or sick leave time may be credited for any such attorney for time worked prior to July 1, 2008, except that any such attorney who, at the time of appointment, had earned paid sick time that had not been used while in a state employee position, may have such sick leave balance restored on said date. Any state employee, on or after July 1, 2008, may carry eligible leave balances forward if appointed to the position of Chief State's Attorney, Deputy Chief State's Attorney or State's Attorney.

This act shall take effect as follows and shall amend the following sections:
