Strike section 2 in its entirety and insert the following in lieu thereof:

"Sec. 2. (Effective from passage) (a) On or before January 31, 2009, the chairpersons of the committee, established pursuant to section 1 of this act, shall certify, in writing, to the joint standing committee of the General Assembly having cognizance of matters relating to public health that the efforts of the committee have: (1) Resulted in an agreement that will facilitate the implementation of a ban on smoking in the state's casinos; (2) resulted in substantial progress being made toward the implementation of a smoking ban in the state's casinos; or (3) not resulted in an agreement that will facilitate the implementation of a ban on smoking in the state's casinos.

(b) If the chairpersons of the committee certify, in accordance with subdivision (1) of subsection (a) of this section, that the efforts of the committee have resulted in an agreement that will facilitate the implementation of a ban on smoking in the state's casinos, the certification from the chairpersons of the committee shall include the significant terms of such agreement, including, but not limited to, the date on which the ban on smoking in the state's casinos shall take effect.

(c) If the chairpersons of the committee certify, in accordance with subdivision (2) of subsection (a) of this section, that the efforts of the committee have resulted in substantial progress toward the implementation of a smoking ban in the state's casinos, the certification from the committee shall detail the progress that has been made and specify the date on which the committee anticipates the ban on smoking taking effect in the state's casinos, provided the implementation of a ban on smoking shall take effect not later than May 1, 2009, and thereafter no person shall smoke in any area of an establishment with a permit issued for the sale of alcoholic liquor pursuant to section 30-37k of the general statutes.

(d) If the chairpersons of the committee certify, in accordance with subdivision (3) of subsection (a) of this section, that the efforts of the committee have not resulted in an agreement that will facilitate the implementation of a ban on smoking in the state's casinos, then, on and after February 1, 2009, no person shall smoke in any area of an establishment with a permit issued for the sale of alcoholic liquor pursuant to section 30-37k of the general statutes.

(e) Nothing in this section shall be construed to prohibit ceremonial tobacco use by persons during a Native American cultural event. "
