MINIMAL COST

The amendment provides that any person found guilty of assault of a pregnant woman resulting in termination of pregnancy is also guilty of a separate charge of murder. An offender could therefore be subject to an additional term of imprisonment of up to twenty five years and a fine of up to $20, 000. The statutory offense of assault of a pregnant woman was created by PA 03-21, effective October 1, 2003. Since that time, it has been used twice in the disposition (one conviction) of cases in the Superior Court. Given the relatively few number of offenses, it is anticipated that the annual marginal cost to criminal justice agencies under the amendment would be minimal. The average cost to incarcerate someone is $41, 600 per year.
