Explanation

The amendment eliminates the provision of the bill that allows the court to deviate from the mandatory minimum sentences for certain nonviolent offenses. The fiscal note on the original bill indicates savings from this provision due to a decrease in the number of incarceration bed days.1 The average daily inmate cost is about $74. Passage of the amendment would eliminate these savings.
