TITLE OF BILL:

AN ACT CONCERNING THE LAWFUL RESIDENCE OF APPLICANTS FOR MOTOR VEHICLE OPERATOR'S LICENSES AND IDENTITY CARDS.

REASONS FOR BILL:

THIS BILL WOULD PREVENT THE ISSUANCE OF DRIVERS LICENSES TO ANY PERSON WHO IS NOT LEGALLY PRESENT IN THE UNITED STATES. THE DRIVERS LICENSE IS THE PRIMARY FORM OF PERSONAL IDENTIFICATION. THIS BILL WOULD MAKE SURE THAT I PERSON IS PROPERLY IDENTIFIED BEFORE THE ISSUANCE OF A DRIVERS LICENSE.

Line 8 After word commissioner change may to "shall" insert bracket before either... insert bracket after parenthesis. On Line 10 after the word state delete comma then insert bracket before the word "or" On Line 13 after the second words "expires" insert bracket after the word and before the period On line 14 after the word card delete "bearing alleged" and insert "under this section" On line 21 insert period after the word "state" bracket before "or" On Line 22 insert bracket after the word "be but before period" Senator Aniskovich amendment passes on a voice vote.

RESPONSE FROM ADMINISTRATION/AGENCY:

DEPARTMENT OF MOTOR VEHICLES STRONGLY SUPPORTS THIS BILL. THE DMV FEELS THAT THIS BILL WOULD BETTER PROTECT PUBLIC SAFETY, WITHOUT FURTHER LIMITING ELIGIBILITY FOR A CONNECTICUT DRIVERS LICENSE OR ID CARD. THEY FEEL IT WOULD CREATE A MEANS FOR THE DEPARTMENT TO ISSUE A CREDENTIAL TO A LAWFUL VISA-HOLDER.

NATURE AND SOURCES OF OPPOSITION:

BOB FISHMAN, CONNECTICUT IMMIGRANT AND REFUGE COALITION. THEY OPPOSE ALL LEGISLATION THAT WOULD PREVENT THE ISSUING OF LICENSES AND IDENTITY DOCUMENTS TO ILLEGAL ALIENS. THEY FEEL IMMIGRATION STATUS IS A FEDERAL ISSUE AND THAT IT WOULD BE MORE APPROPRIATE FOR CONGRESS TO DEAL WITH THIS ISSUE.

FERNANDO BETANCOURT, THE LATINO PUERTO RICAN AFFAIRS COMMISSION. THEY OPPOSE THEY BILL BASED ON THE REJECTION BY THE ATTORNEY GENERAL OF A SIMILAR REGULATION LAST YEAR. THEY ALSO FEEL THAT THIS BILL WOULD BE A VIOLATION OF THE EQUAL PROTECTION CLAUSE OF THE US CONSTITUTION.

MATTHEW CAPECE, NEW ENGLAND REGIONAL COUNCIL OF CARPENTERS. THEY FEEL THAT BY PASSING THIS LAW, THE DMV WILL BE INVOLVING THEM SELVES IN IMMIGRATION LAW, MAKING THEM PSEUDO-IMMIGRATION OFFICERS. THEY ALSO FEEL THAT THIS BILL WOULD DENY LAW FULL IMMIGRANTS LICENSES.

ELIZABETH LEETE, CT CHAPTER OF THE AMERICAN IMMIGRATION LAWYERS. IT IS NOT NECESSARY OR WISE TO RESTRICT THE ISSUANCE OF SUCH LICENSES TOO NARROWLY, ESPECIALLY SINCE A LICENCE ADDS IMPORTANT DATA TO THE DMV DATABASE, WHICH CAN BE AVAILABLE TO LAW ENFORCEMENT AGENCIES ON REQUEST.
