Substitute House Bill No. 6751

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 10-14q of the general statutes is repealed and the following is substituted in lieu thereof:

The provisions of this chapter shall apply to [any student] all students requiring special education pursuant to section 10-76a, except in the rare case when the planning and placement team [of such] for an individual student determines that [it would be inappropriate to allow the student to take the examinations] an alternate assessment as specified by the State Board of Education is appropriate. The provisions of this chapter shall not apply to any student enrolled for [thirty] ten school months or less in a bilingual program pursuant to sections 10-17e and 10-17f or to any student enrolled for [thirty] ten school months or less in an English as a second language program.

Sec. 2. The Department of Education shall conduct a review of the feasibility of providing native language subject matter assessment instruments for use in school districts that provide a program of instruction in bilingual education. The review shall provide information on the availability, utility and cost of such instruments along with the comparability of such assessment instruments to state subject area content standards. The department shall place emphasis on identification of assessment instruments that will provide accurate information on the mastery of subject matter content in the native language of students and those that will provide useful assistance to teachers for improving the teaching methodology in subject matter content areas. The Commissioner of Education shall report, in accordance with section 11-4a of the general statutes, on the review to the joint standing committee of the General Assembly having cognizance of matters relating to education by December 31, 2001.

Sec. 3. This act shall take effect July 1, 2001.
