Policy on Confidentiality and Release of Documents

Requests for Information and Research Reports 

1.  We do not disclose the requesting legislator’s name, without his permission, except to our nonpartisan colleagues who may have information on the subject.

2.  Since request slips are public documents, once a research report has been completed, we will disclose the name of the requesting legislator to anyone who submits a request. We normally require someone to submit a FOI written request although we accept email or fax. It is our practice to inform the affected legislator of the FOI request.

3.  Our reports are public documents; thus, anyone can call the office and request a copy, make copies from the library, or print them from the Web. To ensure that the requesting legislator gets a copy of the report before anyone else, reports are not available until seven days (three days during the session) after we mail them. We can release a report sooner if we know that the legislator has received the report and been able to look at it.

4.  We remove the legislator’s name from reports before posting them on the Web or placing them in the library.

Bill Analyses 

1.  We do not provide copies of bill analyses before they appear on the file or on the CGALites page.

2.  We share with LCO, OFA, bill sponsors, and committee chairmen technical problems with a bill before the analysis is printed in the file.

3.  In rare instances, we share with agencies and other outside authorities or experts portions of draft pre-file analyses if we believe they can be of some assistance.

4.  Once an analysis makes the file, we will give anyone a copy.

5.  We will analyze in research reports (a) bills that are still in committee or just voted out of committee and (b) amendments. We treat these analyses like reports and the above-stated policies apply.

Public Act Summaries 

Public Act summaries are public documents, available to anyone once they have been reviewed.

Information Received from Other Nonpartisan Offices 

With respect to information we receive from other offices, we comply with the providing office’s policy or practice on confidentiality
