TO: DISTRIBUTION FROM: Jo A. Roberts, Senior Attorney DATE: September 10, 1999 RE: Draft of Proposed Revision of Connecticut Statutory Privileges Pursuant to a request by Senator Donald Williams and Representative Michael Lawlor, Co-Chairmen of the Judiciary Committee of the Connecticut General Assembly, the Connecticut Law Revision Commission (the "Commission") undertook a study of the feasibility of revising and unifying key privileges codified in the Connecticut General Statutes. The study is to include a draft bill of revised statutory privileges to be submitted to the General Assembly in the 2000 legislative session.
The Statutory Privileges Study Committee (the "Study Committee") was formed in response to the above request. The Study Committee is chaired by Professor Colin Tait and includes other members and staff of the Commission. (A list of the members of the Study Committee is enclosed.)
The mission of the Study Committee is to revise the present general statutes to move key privilege statutes to one location and to adopt uniform language within the privilege sections. Presently, the various privilege sections use different phraseology to confer the intended privilege and are inconsistent in addressing related matters, such as waiver of or exceptions to each privilege. The enclosed draft of proposed revisions is intended to make consistent, wherever possible, the language and effect of the statutory sections included in the draft.
This draft is intended as a draft for discussion purposes only. Each section is followed by commentary that cites the present location of the section in the general statutes and further explains the Study Committee's intentions. Recipients are encouraged to distribute copies of this draft to other interested persons and need not request further permission from either the Study Committee or the Commission to do so.
The Study Committee will appreciate any comments and recommendations that will assist it in improving the draft before its submission to the General Assembly in the upcoming legislative session. Anyone wishing to comment on this draft may do so by sending comments by mail or FAX to the Law Revision Commission to the attention of Jo Roberts.
