Minutes of December 2, 1998 Meeting
A meeting of the Law Revision Commission Committee on Confidentiality of Medical Records was held commencing at 4:00 p.m. on Wednesday, December 2, 1998 in Hearing Room 1A in the Legislative Office Building in Hartford, Connecticut. Those attending were: Commission members Committee Chairman Joseph J. Selinger, Jr., William R, Breetz, and Joel I. Rudikoff; advisors Larry Berliner, Marie Roberto for Elizabeth Burns, Regina Dacier, Joseph Grabarz, Mary H. Hess, Peter Kane, Stephen Lewis, Richard J. Lynch, David W. Parke, Susan Hamilton for Commissioner Kristine Ragaglia, Donald Roll for Robert Scalettar, Anita L. Schepker, Jeannette C. Schreiber, Nadine Schwab, Patricia Shea, and Bonnie Stewart; and Commission staff David Hemond. Also attending was invited speaker Margo Goldman.
Mr. Selinger called the meeting to order.
The minutes of the November 18 meeting were approved.
Under Agenda Item 2, invited speaker Margo Goldman discussed the Massachusetts initiative on confidentiality of medical information. Her presentation discussed the principles underlying confidentiality, the tension between the need for confidentiality and modern medical practice, and the importance of preserving confidentiality to the doctor-patient relationship. Dr. Goldman reviewed background information as to actions underway on the federal level. She then provided a section by section review of a bill being introduced in the Massachusetts legislature, discussing the background for that effort and then reviewing how the principles of confidentiality would be implemented through the proposed bill. The section by section review included opportunity for a variety of policy discussions concerning the scope of the proposal, the requirement of consents for disclosure, and practical ramifications of the proposed bill provisions.
The next meeting is set for December 16, 1998 at 4:00 p.m. in the Legislative Office Building in Hartford, Connecticut. The primary item on the agenda for that meeting will be a presentation by a providers group led by Jeanette Schreiber concerning information flow and provider policy concerns. The meeting adjourned at 6:15 p.m.
