Proposal for consumer venue provision

(a) In the case of a dispute arising from a consumer contract, unless federal or state law specifically provides or requires otherwise and notwithstanding any conflicting provision within the contract, any proceeding to resolve the dispute between a consumer resident of Connecticut who is a party to the consumer contract and any other party to that contract shall, at the option of any such party, be held at a site within the State of Connecticut that complies with subsection (b).

(b) A site for dispute resolution complies with this subsection if it is (1) within thirty miles of where the consumer resides, or (2) in the county where the consumer resides, or (3) in the county where the transaction occurred.

(c) The provisions of this section may not be waived.

(d) For purposes of this section, consumer contract means a contract in which a natural person is obligated in an amount of fifty thousand dollars or less to pay for goods sold or leased, services rendered, or moneys loaned primarily for personal, family or household purposes.
