The House of Representatives was called to order at 11: 42 o'clock a. m. , Speaker Christopher G. Donovan in the Chair.
Prayer was offered by House Chaplain, Reverend Charles E. Turner of Hartford, Connecticut.
The following is the prayer:
Let us pray. Bless these men and women today that have been chosen to ascend the high mountain of servanthood. Draw them away unto a place of solitude where they can hear clearly the still small voice of their inner selves and where they can dream big about our collective future. Now give them the courage to act, the compassion to aid, and the conscious that respects each others differences. I ask all of this in the name of the one that came not to be served but to serve. Amen.

The following is House Amendment Schedule "A" (LCO 3963):
Strike everything after the enacting clause and substitute the following in lieu thereof:
"Section 1. Subsection (j) of section 31-58 of the general statutes is repealed and the following is substituted in lieu thereof (Effective January 1, 2013):
(j) "Minimum fair wage" in any industry or occupation in this state means a wage of not less than six dollars and seventy cents per hour, and effective January 1, 2003, not less than six dollars and ninety cents per hour, and effective January 1, 2004, not less than seven dollars and ten cents per hour, and effective January 1, 2006, not less than seven dollars and forty cents per hour, and effective January 1, 2007, not less than seven dollars and sixty-five cents per hour, and effective January 1, 2009, not less than eight dollars per hour, and effective January 1, 2010, not less than eight dollars and twenty-five cents per hour, and effective January 1, 2013, not less than eight dollars and fifty cents per hour, and effective January 1, 2014, not less than eight dollars and seventy-five cents per hour or one-half of one per cent rounded to the nearest whole cent more than the highest federal minimum wage, whichever is greater, except as may otherwise be established in accordance with the provisions of this part. All wage orders in effect on October 1, 1971, wherein a lower minimum fair wage has been established, are amended to provide for the payment of the minimum fair wage herein established except as hereinafter provided. Whenever the highest federal minimum wage is increased, the minimum fair wage established under this part shall be increased to the amount of said federal minimum wage plus one-half of one per cent more than said federal rate, rounded to the nearest whole cent, effective on the same date as the increase in the highest federal minimum wage, and shall apply to all wage orders and administrative regulations then in force. The rates for learners, beginners, and persons under the age of eighteen years shall be not less than eighty-five per cent of the minimum fair wage for the first two hundred hours of such employment and equal to the minimum fair wage thereafter, except institutional training programs specifically exempted by the commissioner.
Sec. 2. Subsection (b) of section 31-60 of the general statutes is repealed and the following is substituted in lieu thereof (Effective January 1, 2013):
(b) The Labor Commissioner shall adopt such regulations, in accordance with the provisions of chapter 54, as may be appropriate to carry out the purposes of this part. Such regulations may include, but are not limited to, regulations defining and governing an executive, administrative or professional employee and outside salesperson; learners and apprentices, their number, proportion and length of service; and piece rates in relation to time rates; and shall recognize, as part of the minimum fair wage, gratuities in an amount (1) equal to twenty-nine and three-tenths per cent, and effective January 1, 2009, equal to thirty-one per cent, and effective January 1, 2013, equal to thirty-one and seventy-six hundredths per cent, and effective January 1, 2014, equal to thirty-three and seventy-one hundredths per cent, and effective January 1, 2015, equal to thirty-one per cent of the minimum fair wage per hour for persons, other than bartenders, who are employed in the hotel and restaurant industry, including a hotel restaurant, who customarily and regularly receive gratuities, (2) equal to eight and two-tenths per cent, and effective January 1, 2009, equal to eleven per cent, and effective January 1, 2013, equal to thirteen and sixty-five hundredths per cent, and effective January 1, 2014, equal to sixteen and eleven hundredths per cent, and effective January 1, 2015, equal to eleven per cent of the minimum fair wage per hour for persons employed as bartenders who customarily and regularly receive gratuities, and (3) not to exceed thirty-five cents per hour in any other industry, and shall also recognize deductions and allowances for the value of board, in the amount of eighty-five cents for a full meal and forty-five cents for a light meal, lodging, apparel or other items or services supplied by the employer; and other special conditions or circumstances which may be usual in a particular employer-employee relationship. The commissioner may provide, in such regulations, modifications of the minimum fair wage herein established for learners and apprentices; persons under the age of eighteen years; and for such special cases or classes of cases as the commissioner finds appropriate to prevent curtailment of employment opportunities, avoid undue hardship and safeguard the minimum fair wage herein established. Regulations in effect on July 1, 1973, providing for a board deduction and allowance in an amount differing from that provided in this section shall be construed to be amended consistent with this section without the necessity of convening a wage board or amending such regulations. "

The rates for persons provided paid leave from such person's employer that may be used (1) for (A) such person's illness, injury or health condition, (B) the medical diagnosis, care or treatment of such person's mental illness or physical illness, injury or health condition, or (C) preventative medical care for such person, (2) for (A) such person's, child's or spouse's illness, injury or health condition, (B) the medical diagnosis, care or treatment of such person's, child's or spouse's mental or physical illness, injury or health condition, or (C) preventative medical care for a child or spouse of such person, or (3) where such person is a victim of family violence or sexual assault (A) for medical care or psychological or other counseling for physical or psychological injury or disability, (B) to obtain services from a victim services organization, (C) to relocate due to such family violence or sexual assault, or (D) to participate in any civil or criminal proceedings related to or resulting from such family violence or sexual assault, shall be not less than eighty-five per cent of the minimum fair wage. For the purposes of this subsection, "paid leave" may include, but need not be limited to, paid vacation, personal days or paid time off.
Sec. 2. Sections 31-57r, 31-57s, 31-57t, 31-57u, 31-57v and 31-57w of the general statutes are repealed. (Effective from passage)"

The following is House Amendment Schedule "C" (LCO 4029):
Strike everything after the enacting clause and substitute the following in lieu thereof:
"Section 1. Subsection (j) of section 31-58 of the general statutes is repealed and the following is substituted in lieu thereof (Effective January 1, 2013):
(j) "Minimum fair wage" in any industry or occupation in this state means a wage of not less than six dollars and seventy cents per hour, and effective January 1, 2003, not less than six dollars and ninety cents per hour, and effective January 1, 2004, not less than seven dollars and ten cents per hour, and effective January 1, 2006, not less than seven dollars and forty cents per hour, and effective January 1, 2007, not less than seven dollars and sixty-five cents per hour, and effective January 1, 2009, not less than eight dollars per hour, and effective January 1, 2010, not less than eight dollars and twenty-five cents per hour, and effective January 1, 2013, not less than eight dollars and fifty cents per hour, and effective January 1, 2014, not less than eight dollars and seventy-five cents per hour or one-half of one per cent rounded to the nearest whole cent more than the highest federal minimum wage, whichever is greater, except as may otherwise be established in accordance with the provisions of this part. All wage orders in effect on October 1, 1971, wherein a lower minimum fair wage has been established, are amended to provide for the payment of the minimum fair wage herein established except as hereinafter provided. Whenever the highest federal minimum wage is increased, the minimum fair wage established under this part shall be increased to the amount of said federal minimum wage plus one-half of one per cent more than said federal rate, rounded to the nearest whole cent, effective on the same date as the increase in the highest federal minimum wage, and shall apply to all wage orders and administrative regulations then in force. The rates for learners, beginners, and persons under the age of eighteen years shall be not less than eighty-five per cent of the minimum fair wage for the first two hundred hours of such employment and equal to the minimum fair wage thereafter, except institutional training programs specifically exempted by the commissioner.
Sec. 2. Subsection (b) of section 31-60 of the general statutes is repealed and the following is substituted in lieu thereof (Effective January 1, 2013):
(b) The Labor Commissioner shall adopt such regulations, in accordance with the provisions of chapter 54, as may be appropriate to carry out the purposes of this part. Such regulations may include, but are not limited to, regulations defining and governing an executive, administrative or professional employee and outside salesperson; learners and apprentices, their number, proportion and length of service; and piece rates in relation to time rates; and shall recognize, as part of the minimum fair wage, gratuities in an amount (1) equal to twenty-nine and three-tenths per cent, and effective January 1, 2009, equal to thirty-one per cent, and effective January 1, 2013, equal to thirty-one and seventy-six hundredths per cent, and effective January 1, 2014, equal to thirty-three and seventy-one hundredths per cent of the minimum fair wage per hour for persons, other than bartenders, who are employed in the hotel and restaurant industry, including a hotel restaurant, who customarily and regularly receive gratuities, (2) equal to eight and two-tenths per cent, and effective January 1, 2009, equal to eleven per cent, and effective January 1, 2013, equal to thirteen and sixty-five hundredths per cent, and effective January 1, 2014, equal to sixteen and eleven hundredths per cent of the minimum fair wage per hour for persons employed as bartenders who customarily and regularly receive gratuities, and (3) not to exceed thirty-five cents per hour in any other industry, and shall also recognize deductions and allowances for the value of board, in the amount of eighty-five cents for a full meal and forty-five cents for a light meal, lodging, apparel or other items or services supplied by the employer; and other special conditions or circumstances which may be usual in a particular employer-employee relationship. The commissioner may provide, in such regulations, modifications of the minimum fair wage herein established for learners and apprentices; persons under the age of eighteen years; and for such special cases or classes of cases as the commissioner finds appropriate to prevent curtailment of employment opportunities, avoid undue hardship and safeguard the minimum fair wage herein established. Regulations in effect on July 1, 1973, providing for a board deduction and allowance in an amount differing from that provided in this section shall be construed to be amended consistent with this section without the necessity of convening a wage board or amending such regulations. "

(l) The sale of wine at a farmers' market by a permittee holding a farmers' market wine sales permit pursuant to subsection (a) of section 30-37o shall be unlawful [on Sunday and] on any [other] day before eight o'clock a. m. and after nine o'clock p. m. , provided such permittee shall not sell such wine at a farmers' market at any time during such hours that the farmers' market is not open to the public. Any town may, by vote of a town meeting or by ordinance, reduce the number of hours during which sales of wine under this subsection shall be permissible. "

FAVORABLE REPORT OF JOINT STANDING COMMITTEE
HOUSE BILL PASSED
The following bill was taken from the table, read the third time, the report of the committee indicated accepted and the bill passed.
APPROPRIATIONS. Substitute for H. B. No. 5445 (RAISED) (File No. 569) AN ACT CONCERNING SUPPLEMENTAL PAYMENTS UNDER THE CONNECTICUT ENERGY ASSISTANCE PROGRAM.
The bill was explained by Representative Abercrombie of the 83rd who offered House Amendment Schedule "A" (LCO 4033) and moved its adoption.
The amendment was discussed by Representative Miner of the 66th.
On a voice vote the amendment was adopted.
The Speaker ruled the amendment was technical.
The following is House Amendment Schedule "A" (LCO 4033):
Strike everything after the enacting clause and substitute the following in lieu thereof:
"Section 1. (Effective from passage) Each electric distribution or gas company that receives, on behalf of any of its customers, payments under the Connecticut energy assistance program during the federal fiscal year ending September 30, 2012, shall deduct an amount equal to such payments from the customer's delinquent account if such deduction is not otherwise made pursuant to subdivision (4) of subsection (b) of section 16-262c of the general statutes. Any such deduction shall be made in the billing cycle immediately succeeding the date on which such company receives a payment from the Connecticut energy assistance program on behalf of such customer. In no event shall the deduction of any amounts pursuant to this section result in a credit balance to the customer's account. The cost of customer account deductions made pursuant to this section shall be paid through the normal rate-making procedures of the Public Utilities Regulatory Authority for a gas company and through the systems benefits charge for an electric distribution company. "
