OLR BILL ANALYSIS
AN ACT PERMITTING MUNICIPAL EMPLOYEES TO SERVE AS CITATION HEARING OFFICERS.
This bill permits, rather than requires, a municipality's chief executive officer (CEO) to appoint one or more citation hearing officers and authorizes the CEO to appoint a municipal employee as a citation hearing officer, which current law prohibits. But if a town issues citations, the law requires it to provide a hearing before a citation hearing officer if a person contests his or her liability and a town must still appoint a hearing officer for this purpose.
Existing law, unchanged by the bill, prohibits a CEO from appointing a (1) police officer or a person who issues citations as a citation hearing officer and (2) zoning enforcement officer, building inspector, or an employee of the municipality's zoning authority as a hearing officer for contested zoning citations.
