"AN ACT REVISING THE PENALTY FOR CAPITAL FELONIES. "

After the last section, add the following and renumber sections and internal references accordingly:

"Sec. 501. (NEW) (Effective from passage) (a) Notwithstanding the provisions of this act, any person convicted of murder with special circumstances under subdivision (1) of section 53a-54b of the general statutes, as amended by this act, for the murder of an employee of the Department of Correction or a person providing services on behalf of said department when such employee or person is acting within the scope of such employee's or person's employment or duties in a correctional institution or facility and the actor is confined in such institution or facility, committed on or after the effective date of this section, shall be sentenced to a term of life imprisonment without the possibility of release unless a sentence of death is imposed in the manner prescribed in section 53a-46a of the general statutes, as amended by this act.

(b) The provisions of this act applicable to a person who commits a capital felony prior to the effective date of this section shall apply in like manner to a person convicted of murder as provided in subsection (a) of this section. "


This act shall take effect as follows and shall amend the following sections:
