AN ACT CONCERNING SERVICE OF PROCESS FEES WITH RESPECT TO FORECLOSURE.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 52-261 of the general statutes be amended to provide that officers and persons who serve process, summons or attachments with respect to a foreclosure may receive only one service fee when the lis pendens is an attachment to the writ, summons and complaint and that the dollar per page fee is only earned when the copy is in fact made by the officer or person.

Statement of Purpose:

To limit certain service of process fees in order to protect individuals and businesses facing foreclosure.
