Subdiv. (4): Although part performance may be sufficient to take a contract out of the statute of frauds, plaintiffs'
maintenance of city landscaping on the land was evidence of an agreement between plaintiffs and the city, not evidence
of an agreement between plaintiffs and defendant to sell the land. 99 CA 294.
