Explanation

The amendment removes Section 1 of the bill, which would have enabled a municipality to delay or preclude certain pending licenses or state contracts. This eliminates the possibility of delayed or averted payments of state funds to providers, and/or the potential need for a state agency to incur different costs to secure an alternate site when pursuing a contract involving a residential facility previously operated by a person or entity licensed as a child-care facility by the Department of Children and Families.

It also eliminates Section 2 of the bill, which had no associated fiscal impact.

The amendment permits any person related to a child or youth to file a motion to intervene for purposes of seeking temporary custody.  It specifies that any such relative shall not be entitled to court-appointed counsel.  These provisions could increase the complexity and length of certain court cases.  However, it is anticipated that any such increase could be handled without requiring additional court staff or expenses. 

Finally, the amendment makes numerous other changes to Sections 3, 5 and 6 of the bill which do not result in a fiscal impact.
