SELECTMEN SERVING AS EX OFFICIO MEMBERS OF PLANNING AND ZONING COMMISSIONS

You asked if CGS § 7-12a prohibits second and third selectmen from serving as ex officio members of a planning and zoning commission. The response requires an official legal opinion, which the Office of Legislative Research cannot give. Consequently, you should not regard this report as providing one.

The answer turns on whether the statute implicitly prohibits the second and third selectmen from serving ex officio on the planning and zoning commission. The statute specifies only the conditions under which the first selectman must serve as the town's chief executive authority and non voting ex officio member of every board, commission, and committee (i. e. , the board of selectmen is the town's executive authority and the law governing the other bodies do not prohibit the first selectmen from serving on them as an ex officio member). It does not address whether the other selectmen can serve as ex officio members of other boards, commissions, and committees.
