AN ACT REQUIRING A DISCLOSURE STATEMENT WHEN A STATE OR LOCAL GOVERNMENT AGENCY REQUESTS AN INDIVIDUAL'S SOCIAL SECURITY NUMBER.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2007) Any department, board, commission, institution or other agency of the state or political subdivision of the state, including a constituent unit of the state system of higher education, that requests an individual to disclose such individual's Social Security number shall inform such individual: (1) Whether such disclosure is mandatory or voluntary, (2) by what statutory or other authority such number is solicited, and (3) what uses will be made of such number.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To protect an individual's privacy and reduce the opportunity for identity theft by enacting provisions consistent with the Federal Privacy Act of 1974 to require state and local agencies, including state colleges and universities, that request an individual's Social Security number to disclose whether providing such number is mandatory or voluntary, the authority for making such request and the uses to which such number will be made.
