PESTICIDE ADVISORY COMMITTEE

By: Joseph Holstead, Associate Analyst

You asked when the Pesticide Advisory Committee met last.

The council last met sometime in the early 1990s, according to the Department of Environmental Protection (DEP).

The law stipulates that DEP's commissioner may consult with the Pesticide Advisory Council (1) on technical matters involving the application and use of pesticide and (2) to determine imminent hazards and the unreasonable, adverse effects on the environment before promulgating regulations or orders to carry out laws concerning pesticides.

The statute requires DEP's commissioner to establish the council and stipulates that (1) its membership must consist of, at least, the director of the Agricultural Experiment Station, the Agriculture and Public Health commissioners, and the dean of the college of agriculture of the University of Connecticut, or their designees and (2) the council meet at least annually (CGS § 22a-65).

DEP currently consults with director of the Agricultural Experiment Station, the Agriculture and Public Health commissioners, and the dean of the college of agriculture of the University of Connecticut, and other stake holders, when it develops pesticide regulations and reviews other pesticide matters. DEP is able to consult with these entities outside of the formal annual meeting required by the statute; DEP may request the statute be repealed for this reason, according to Tom Tyler, DEP Legislative Liaison.
