OTHER STATES WC BENEFITS SUBJECT TO SOCIAL SECURITY OFFSETS | ||

You asked what other states reduce workers' compensation temporary total disability (TTD) benefits for claimants who are also receiving Social Security old age benefits.
Ten states, like Connecticut, reduce a claimant's TTD benefits by the amount the person receives in Social Security old age benefits. (One terminates workers' compensation (WC) when the claimant qualifies for Social Security. ) In other words, the claimant receives only the amount by which his WC benefit exceeds his Social Security benefit. This is referred to as the Social Security benefit offset for WC.
The other states with this offset are: Alaska, Colorado, Florida, Kansas, Michigan, Montana, Ohio, Pennsylvania, Washington, and Wisconsin. Louisiana repealed its Social Security offset a few years ago.
In Kentucky, WC benefits terminate completely when the claimant qualifies for Social Security benefits.
The TTD offset is the only one under Connecticut WC law for Social Security old age benefits. Some other states offset other types of benefits. For example 13 states (including all 10 mentioned above) have offsets for permanent total disability claims.
