CHILD SUPPORT AUDITS

By: Susan Price, Principal Legislative Analyst

You asked if any of Connecticut's neighboring states audit child support payments to ensure that they are used exclusively to support the child for whom they are intended and not as a substitute for alimony for the custodial parent.

None of Connecticut's neighboring states (Massachusetts, New Jersey, New York, Rhode Island, New Hampshire, Vermont, and Maine) audit how custodial parents spend child support. But courts can impose a constructive trust on child support payments to prevent a custodial parent from misappropriating them for her own benefit (76 Am. Jur. 2d Sec. 176).
