REDUCES POTENTIAL COST IN BILL
The amendment establishes graduated penalties depending upon the circumstances of the crime. Provided certain conditions are met, an offender could be charged with a class “A” misdemeanor under the amendment rather than a class “D” felony pursuant to the bill. This change would reduce the potential cost associated with incarceration and/or probation supervision under the bill. Note that in FY 05 there were 34 convictions under Section 53a-222 of the CGS. It is unknown how many of these offenses would be affected by the amendment.
