Explanation
The bill clarifies that the offer of judgment provisions in effect prior to the effective date of public act 05-275 are applicable to actions accruing before October 1, 2005. There is no fiscal impact associated with this change. The bill also specifies that certain state institutions or facilities qualify under the provision in public act 05-275 making expressions of sympathy by health care providers inadmissible in lawsuits by victims of unanticipated outcomes of medical care. This change could result in cost avoidance for the state.
Senate Amendment “A” could reduce the likelihood that the state would be involved as a defendant in any civil action to recover damages arising from an alleged instance of medical malpractice. As such, the state could avoid the potential costs associated with litigation and/or the payment of claims.
