NET EXPENDITURES IN THE 2004 SENATE RACES

This report looks at spending by Senate candidates in the 2004 legislative races on expenses other than surplus distributions. By law, candidate committees must distribute residual or surplus funds (1) within 90 days of a primary when a candidate loses, or an election or a referendum not held in November or (2) by January 31st following an election or referendum occurring in November (CGS § 9-333j(e)). The organizations and people currently eligible to receive the surplus are party committees, ongoing PACs, charitable organizations, and contributors on a prorated basis. As used in the report “total expenditures” means the aggregate expenditures, including any surplus distribution, that a candidate committee reported spending during the election cycle. “Net expenditures” means the total expenditures less any surplus distributions and, in two instances, including any deficit.

Table 1 shows the total and net expenditures for each candidate in the 2004 Senate races. The information is based on the final “Statement of Receipts and Expenditures” (ED-45) that candidates filed with the Office of the Secretary of the State when their candidate committee terminated. According to the State Elections Enforcement Commission, candidates are supposed to indicate their surplus distribution on the form by using an “SD” code. But we encountered numerous instances where the candidate used the code for charity (CH) or contributions to other committees (C) in addition to, or in lieu of, the “SD” code. In the table, we use the term “surplus distribution” generically to refer to all surplus distributions, regardless of the recipient.

In most instances, candidates filed their final Statement of Receipts and Expenditures on January 7, 2005. However, those with outstanding expenses on that date filed additional statements. In these cases, we took information from the January 7th and subsequent reports to get a complete picture of the candidates’ expenditures and distributions or deficits, if any. Candidates who financed their campaigns entirely from personal funds or did not receive or spend over $ 1,000 from other sources are exempt from the filing requirement as we note in the table (CGS § 9-333j(b)). Of the 85 Senate candidates, 59 were not exempt and their average total expenditures was $ 72,349. 27 while their average net expenditures was $ 64,801. 06.

In two cases, candidates showed a deficit at the time of this report and we indicate that in parentheses in the net expenditures column. One of those candidates, Christopher Murphy, shows both a deficit and a surplus. For Bill Kiner, we use the total expenditures reflected in OLR Report 2005-R-0254. However, the last report filed by the candidate is a deficit report that shows a positive balance. We also use OLR Report 2005-R-0254 to determine the total expenditures for Christopher O’Brien, Ernest Newton, and Arlo Ellison.

We looked at aggregate expenditures (Column B, Line 9) and balance (Column B, Line 10) candidates reported on their termination report or last filed report to determine whether an account was balanced or had a deficit.

We took candidate’s total reported expenditures from data compiled by OLR fellows in OLR Report 2005-R-0254.

Number does not include candidates who were exempt from filing.
