You asked whether HB 6616, An Act Concerning Ethics in State and Municipal Government, which was introduced in the 2005 legislative session required everyone making presentations to a municipal board to be registered as lobbyists.
HB 6616, among other things, (1) established a code of ethical conduct for municipal and special district officials, employees, and paid consultants; (2) required municipalities and special districts to adopt the code or a stricter one by July 1, 2006; and (3) regulated municipal lobbying in primarily the same manner as state lobbyists.
The code the bill established would have limited appearances by municipal and district officials and employees, former officials and employees, and paid consultants before certain agencies, boards, and committees in an effort to prevent conflicts of interests. However, nothing in the bill would have required everyone making a presentation to such bodies to be registered lobbyists.
With certain exceptions, the lobbying provisions in the bill would have required anyone who receives, spends, or agree to receive or spend at least $ 2,000 in a calendar year to influence legislative or administrative action in a single municipality to register as lobbyists with the Office of State Ethics. After favorable reports by the Government Administration and Elections, Planning and Development, Labor and Public Employees, Judiciary, Appropriations, and Legislative Management committees, HB 6616 died on the House calendar.
