You asked if New York’s smoking ban exempts private clubs.
New York exempts “membership associations” from the ban on smoking in the workplace if certain conditions are met.
By law, a “membership association” is a nonprofit entity created for a charitable, philanthropic, educational, political, social, or similar purpose. Such an association is exempt only if unpaid members perform all of the duties concerned with association’s operation, including food and beverage preparation and service, reception, and secretarial work (N. Y. Pub. Health Law §§ 1999-n and 1399-q).
