FAIR TRADE ACT

      *Act not unconstitutional because it enables one seller to fix the price at which another may sell. 128 C. 602.

      Rights of persons under this act who are not the owners of the trademark. 9 CS 110. Modern concept of the public good placing the emphasis on the protection of the merchant rather than on the cost to the public is indicated in this chapter. Id., 241.

      Does not prohibit retailer from charging higher price for commodity than stipulated minimum. 22 CS 116. Constitutionality discussed; act does not prevent one who purchases a commodity from its producer from selling it, without the trademark, at any price he pleases. Act interferes only when he sells the commodity with the aid of the good will of the producer. Aim of act to protect property, namely, the good will, of the producer. 23 CS 263.
