AN ACT CONCERNING ASSAULT OF A PREGNANT WOMAN
SUMMARY: This act makes it a class A (see Table on Penalties) felony for anyone to assault a pregnant woman and cause her pregnancy to terminate without a live birth. The offender must (1) intend to cause serious physical injury and (2) cause the injury with a deadly weapon or dangerous instrument.
It is an affirmative defense that the offender did not know the victim was pregnant at the time of the offense. By law, defendants must prove an affirmative defense by a preponderance of the evidence.
