You asked for a follow-up to OLR Report 2003-R-0078, Juveniles Transferred to Adult Court. You want to know the sentences the transferred juveniles received from the Superior Court.
In OLR Report 2003-R-0078, we reported that the Superior Court imposed a sentence of incarceration in 21 of the 110 juveniles cases transferred from juvenile to adult court during FY 2001-2002. The court (1) imposed a split sentence of incarceration and probation in 14 of the 21 cases, (2) imposed a straight sentence of incarceration in six, and (3) revoked probation once and, we assume, sentenced the offender to a period of incarceration.
We asked the Judicial Department for the sentence data to match the disposition data they provided for OLR Report 2003-R-0078. For FY 2001-2002, the sentence data shows 25 cases where a period of incarceration was ordered, four cases more than the disposition data shows. The only explanation for the difference is that the information came from two different sources, according to Stephen Ment, Judicial Department Division of External Affairs.
The incarceration sentences imposed in the transferred cases ranged from six months for first-degree assault to 30 years for murder. Table 1 shows the sentence lengths by days and years, the crime committed, and the number of cases for which the sentence was imposed.
