Special Act No. 03-15

AN ACT TRANSFERRING FUNDS TO AGENCIES WITH DEFICIENCIES FOR THE FISCAL YEAR ENDING JUNE 30, 2003.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective from passage) The sum of $ 150,000 appropriated to the Department of Environmental Protection, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Military Department, for Honor Guards.

Sec. 2. (Effective from passage) (a) (1) The sum of $ 3,393,220 appropriated to Legislative Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 1,395,828 appropriated to Legislative Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(b) The sum of $ 450,000 appropriated to Auditors of Public Accounts, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(c) The sum of $ 49,718 appropriated to the Permanent Commission on the Status of Women, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(d) The sum of $ 48,486 appropriated to the Commission on Children, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(e) The sum of $ 31,624 appropriated to the Latino and Puerto Rican Affairs Commission, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(f) The sum of $ 26,040 appropriated to the African-American Affairs Commission, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(g) The sum of $ 150,000 appropriated to the Governor's Office, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(h) The sum of $ 115,380 appropriated to the Secretary of the State, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(i) The sum of $ 19,936 appropriated to the Elections Enforcement Commission, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(j) The sum of $ 18,880 appropriated to the Ethics Commission, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(k) The sum of $ 39,146 appropriated to the Freedom of Information Commission, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(l) The sum of $ 10,009 appropriated to the State Properties Review Board, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(m) (1) The sum of $ 260,552 appropriated to the State Treasurer, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 41,015 appropriated to the State Treasurer, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(n) (1) The sum of $ 596,502 appropriated to the State Comptroller, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 320,665 appropriated to the State Comptroller, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(o) (1) The sum of $ 1,228,722 appropriated to the Department of Revenue Services, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 122,408 appropriated to the Department of Revenue Services, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Collection and Litigation Contingency Fund, shall be transferred to the Department of Social Services, for Medicaid.

(p) (1) The sum of $ 512,321 appropriated to the Division of Special Revenue, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 92,501 appropriated to the Division of Special Revenue, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(q) (1) The sum of $ 1,063,301 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 107,014 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(3) The sum of $ 60,078 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Drugs Don't Work, shall be transferred to the Department of Social Services, for Medicaid.

(4) The sum of $ 544,777 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Leadership, Education, Athletics in Partnership (LEAP), shall be transferred to the Department of Social Services, for Medicaid.

(5) The sum of $ 140,772 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Children and Youth Program Development, shall be transferred to the Department of Social Services, for Medicaid.

(6) The sum of $ 703,850 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Justice Assistance Grants, shall be transferred to the Department of Social Services, for Medicaid.

(7) The sum of $ 61,295 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Neighborhood Youth Centers, shall be transferred to the Department of Social Services, for Medicaid.

(8) The sum of $ 63,288 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Boys and Girls Club, shall be transferred to the Department of Social Services, for Medicaid.

(9) The sum of $ 486,354 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for OTHER THAN PAYMENTS TO LOCAL GOVERNMENTS Drug Enforcement Program, shall be transferred to the Department of Social Services, for Medicaid.

(10) The sum of $ 131,000 appropriated to the Office of Policy and Management, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Waste Water Treatment Facility Host Town Grant, shall be transferred to the Department of Social Services, for Medicaid.

(r) The sum of $ 435,886 appropriated to the Department of Veterans' Affairs Services, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(s) (1) The sum of $ 115,649 appropriated to the Office of Workforce Competitiveness, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 24,625 appropriated to the Office of Workforce Competitiveness, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(t) (1) The sum of $ 1,040,094 appropriated to the Department of Administrative Services, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 260,663 appropriated to the Department of Administrative Services, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(3) The sum of $ 21,534 appropriated to the Department of Administrative Services, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Loss Control Risk Management, shall be transferred to the Department of Social Services, for Medicaid.

(u) (1) The sum of $ 96,851 appropriated to the Department of Information Technology, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 250,000 appropriated to the Department of Information Technology, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Automated Personnel System, shall be transferred to the Department of Social Services, for Medicaid.

(v) (1) The sum of $ 67,932 appropriated to the Department of Public Works, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 273,909 appropriated to the Department of Public Works, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Management Services, shall be transferred to the Department of Social Services, for Medicaid.

(3) The sum of $ 382,786 appropriated to the Department of Public Works, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Rents and Moving, shall be transferred to the Department of Social Services, for Medicaid.

(4) The sum of $ 274,462 appropriated to the Department of Public Works, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Facilities Design Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(w) The sum of $ 1,060,045 appropriated to the Attorney General, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(x) The sum of $ 12,483 appropriated to the Office of the Claims Commissioner, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(y) (1) The sum of $ 1,376,859 appropriated to the Division of Criminal Justice, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 134,684 appropriated to the Division of Criminal Justice, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(dd) (1) The sum of $ 289,243 appropriated to the Labor Department, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 30,356 appropriated to the Commission on Human Rights and Opportunities, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(ff) (1) The sum of $ 112,949 appropriated to the Office of Protection and Advocacy for Persons with Disabilities, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 21,401 appropriated to the Office of Protection and Advocacy for Persons with Disabilities, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(gg) The sum of $ 34,775, appropriated to the Office of the Child Advocate, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(hh) (1) The sum of $ 156,893 appropriated to the Department of Agriculture, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 35,165 appropriated to the Department of Agriculture, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(ii) The sum of $ 171,213 appropriated to the Department of Environmental Protection, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(jj) (1) The sum of $ 238,435 appropriated to the Department of Economic and Community Development, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 143,815 appropriated to the Department of Economic and Community Development, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(3) The sum of $ 42,500 appropriated to the Department of Economic and Community Development, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Cluster Initiative, shall be transferred to the Department of Social Services, for Medicaid.

(4) The sum of $ 374,300 appropriated to the Department of Economic and Community Development, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Subsidized Assisted Living Demonstration, shall be transferred to the Department of Social Services, for Medicaid.

(5) The sum of $ 255,092 appropriated to the Department of Economic and Community Development, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Congregate Facilities Operation Costs, shall be transferred to the Department of Social Services, for Medicaid.

(kk) (1) The sum of $ 142,771 appropriated to the Agricultural Experiment Station, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 14,578 appropriated to the Agricultural Experiment Station, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(ll) (1) The sum of $ 1,257,172 appropriated to the Department of Public Health, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to the Department of Social Services, for Medicaid.

(2) The sum of $ 324,570 appropriated to the Department of Public Health, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Other Expenses, shall be transferred to the Department of Social Services, for Medicaid.

(3) The sum of $ 16,640 appropriated to the Department of Public Health, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Needle and Syringe Exchange Program, shall be transferred to the Department of Social Services, for Medicaid.

(5) The sum of $ 53,994 appropriated to the Public Defender Services Commission, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Expert Witnesses, shall be transferred to the Department of Social Services, for Medicaid.

Sec. 3. (Effective from passage) The sum of $ 6,500,000 appropriated to the Department of Public Safety, in section 11 of special act 01-1 of the June special session, as amended by section 19 of public act 02-1 of the May 9 special session, for Personal Services, shall be transferred to Workers' Compensation Claims - Department of Administrative Services, for Workers' Compensation Claims.

Sec. 4. (Effective from passage) The sum of $ 100,000 transferred to the Office of Workforce Competitiveness in section 17 of public act 02-1 of the May 9 special session, as amended by section 108 of public act 02-7 of the May 9 special session and section 4 of public act 03-2, for Workforce Development Boards, and the sum of $ 150,000 transferred to the Judicial Department in said section 17, as amended, for Alternative Incarceration Program, shall be transferred to the Department of Social Services, for the fiscal year ending June 30, 2003, for Housing/Homeless Services, for Homes for the Brave in Bridgeport. Such funds shall not lapse on June 30, 2003, and shall continue to be available for expenditure for such purpose during the fiscal year ending June 30, 2004.

Sec. 5. (Effective from passage) Notwithstanding the provisions of section 4-89 of the general statutes, the Secretary of the Office of Policy and Management may order the unexpended balance of any appropriation to be continued for the ensuing fiscal year if the agency to which the appropriation was made demonstrates the inability to expend the appropriation due to the Early Retirement Incentive Program (ERIP).

Sec. 6. Section 40 of public act 02-1 of the May 9 special session is amended to read as follows (Effective from passage):

Notwithstanding any provision of the general statutes, for the fiscal year ending June 30, 2003, the sum of $ 1,000,000 in the Private Occupational School Student [Benefit] Protection account, shall be credited to the resources of the General Fund.
