ADVANCE NON-RENEWAL NOTICE
By: Jerome Harleston, Senior Attorney
You asked whether a workers' compensation insurer could renew a policy for a 30- or 60-day period, after he failed to give the insured the required 60-day advance notice of non-renewal.
No, the insured is entitled to (1) renew the policy for a term of not less than one year or (2) pro-rata cancellation of the policy at the lower of the current or previous year's rate. The insured must exercise these rights within 60 days from the policy's renewal or anniversary day (CGS § 38a-323(c)).
